Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Cruisa mobile application and related services (collectively, the “Service”) operated by Cruisa, Inc. (“Cruisa,” “we,” “us,” or “our”).

By creating an account or using Cruisa, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

Cruisa is only for users who are at least 18 years old. By creating an account, you represent and warrant that you are at least 18 years old and legally able to agree to these Terms.

If we determine, including through user reports and moderation processes, that you are under 18 or misrepresented your age, we may suspend or permanently ban your account.

2. Your Account

You may create an account using Sign in with Apple. You are responsible for maintaining control of the device and Apple account used to access Cruisa.

You agree to provide accurate information and keep your profile information up to date. You may not create an account for someone else, impersonate another person, or create a new account after being banned.

3. User Profiles, Photos, Comments, and Messages

Cruisa allows users to create profiles, upload photos, send one-to-one messages, post public comments, and interact with other users.

You are responsible for content you upload, send, post, or otherwise make available through the Service (“User Content”). You represent that you have the rights necessary to post your User Content and that your User Content does not violate these Terms or the rights of others.

At this time, users may replace or delete their own profile photos in the app, but may not be able to delete their own comments or messages in-app.

4. License to User Content

You retain ownership of your User Content. However, by posting, uploading, sending, or making User Content available through Cruisa, you grant Cruisa a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, distribute, modify, adapt, and use your User Content as necessary to operate, improve, moderate, promote, and provide the Service.

This license ends when your User Content is deleted from our systems, except where content has been shared with others, anonymized, retained for safety or legal reasons, or stored in backups.

5. Location-Based Features

Cruisa uses location-based features to help users discover other users and events. Users may be shown to other users based on location-based discovery features.

Cruisa may display maps, addresses, and location-related information using Apple MapKit and Apple Maps. Apple’s map data, legal notices, logos, and attribution must remain visible where displayed in the app.

You are responsible for deciding what information to share and whether to meet or interact with other users.

Cruisa does not guarantee the accuracy of location-based information and is not responsible for user interactions, whether online or offline.

6. Safety and Offline Interactions

Cruisa is a platform for users to discover and interact with others. We do not guarantee the identity, intentions, conduct, background, or safety of any user. Unless expressly stated otherwise, Cruisa does not conduct criminal background checks or identity verification on users.

You are solely responsible for your interactions with other users. Use common sense and caution, especially when meeting someone in person. Meet in public places, tell someone you trust where you are going, and do not share sensitive personal or financial information with other users.

7. Prohibited Conduct

You agree not to:

Use Cruisa if you are under 18
Misrepresent your age, identity, affiliation, or intentions
Harass, threaten, abuse, stalk, exploit, or harm others
Post or send hate speech, violent threats, sexually exploitative content, or illegal content
Upload content that infringes another person’s rights
Spam, scam, phish, solicit money, or engage in fraudulent activity
Use Cruisa for commercial solicitation without permission
Scrape, copy, reverse engineer, or misuse the Service
Interfere with the security or operation of Cruisa
Create a new account after suspension or ban
Encourage others to violate these Terms

8. Reports, Blocks, Moderation, and Bans

Users may block or report other users. Cruisa may review reports, user activity, messages, comments, photos, account information, and related data to enforce these Terms and our Community Guidelines.

Cruisa may automatically suspend or ban accounts after receiving a sufficient number of reports or based on other signals of abuse, fraud, safety risk, or policy violations. We may remove content, restrict features, suspend accounts, permanently ban users, or take other action at our discretion.

If you are banned, we may retain limited or anonymized information necessary to support appeals, enforce the ban, prevent repeat abuse, protect users, and maintain Service safety.

9. Cruisa Premium and Subscriptions

Cruisa may offer paid subscription features under the name “Cruisa Premium.” Example premium features may include enhanced discovery, increased visibility, advanced filters, or other paid features. Actual subscription features, pricing, trial availability, and subscription options may change and will be presented in the app before purchase.

Cruisa Premium may be available as monthly and annual auto-renewable subscriptions. Cruisa may offer eligible new subscribers a free trial, such as a 7-day free trial for the monthly Cruisa Premium subscription. After the free trial ends, the subscription automatically renews on a monthly basis unless canceled through your Apple ID subscription settings before the trial or renewal period ends.

Subscriptions and free trials are processed by Apple through your Apple ID. Your subscription automatically renews unless canceled through your Apple ID subscription settings before the renewal date.

Cruisa does not directly process your payment card information. Refunds, cancellations, and billing issues are generally handled by Apple according to Apple’s policies.

Deleting your Cruisa account or deleting the app does not automatically cancel your Apple subscription or free trial. You are responsible for canceling your subscription through your Apple ID subscription settings.

10. Account Deletion

You may delete your Cruisa account through the app or by contacting support@cruisa.io.

When you delete your account, we generally delete your profile, photos, stored location coordinates, push notification token, and account information from active use. Messages and public comments may be anonymized rather than fully deleted. We may retain limited information for safety, fraud prevention, legal compliance, dispute resolution, enforcement, appeals, and to prevent banned users from creating new accounts.

11. Intellectual Property

Cruisa, including its design, software, logos, trademarks, features, and content other than User Content, is owned by Cruisa, Inc. or its licensors and is protected by intellectual property laws.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works based on Cruisa except as permitted by law or authorized by us.

12. Third-Party Services

Cruisa uses third-party services such as Apple, Apple MapKit, Apple Maps, and Google Firebase. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services that we do not control.

13. No Warranty

Cruisa is provided “as is” and “as available.” We do not guarantee that the Service will be uninterrupted, secure, error-free, accurate, or available at all times. We disclaim all warranties to the fullest extent permitted by law.

14. Limitation of Liability

To the fullest extent permitted by law, Cruisa, Inc. and its officers, directors, employees, contractors, agents, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or other intangible losses arising from or relating to your use of the Service.

To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of: (a) the amount you paid to Cruisa in the three months before the claim arose, or (b) $100.

15. Indemnity

You agree to defend, indemnify, and hold harmless Cruisa, Inc. and its officers, directors, employees, contractors, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses arising from or related to your use of the Service, your User Content, your violation of these Terms, or your violation of any rights of another person.

16. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

17. Changes to These Terms

We may update these Terms from time to time. If changes are material, we may notify you through the app, by email, or by other reasonable means. Continued use of Cruisa after updated Terms become effective means you accept the updated Terms.
